       MAINTENANCE TO SENIOR CITIZENS

Indian law requires an able-bodied person who has means to maintain and support their parents, which include biological, step-parents and adoptive parents, in the similar manner that a person has to maintain his wife and children. However for senior citizens, a special law was enacted: The Maintenance and Welfare Of Parents And Senior Citizens Act, 2007, under which a senior citizen (above 60 years) can get maintenance from his adult children or legal heir. However, this is not the only act under which the parents/ senior citizens can seek maintenance from their children.

A Hindu Biological/Adoptive parent, who is aged/infirmed, can seek maintenance from their grown children under the Hindu Adoptions and Maintenance Act, 1956 if they are unable to maintain themselves from their own earning or property. In the event, when the son or daughter is no more, parents can still claim maintenance from the wealth and properties of the deceased child This law does not provide maintenance to step parent or parents of other religions. 

Any parent be it biological/ adoptive/ step parent can also claim maintenance under Section 125 of the Code of Criminal Procedure (Better known as CrPC 125), if any person with sufficient resources refuses or ignores to maintain parents who are unable to maintain themselves. This law is secular in nature and is applicable to all citizens of India.

Quantum/ Amount of Maintenance:


Under any of the above acts, there is no standard sum of money awarded as maintenance. It is
decided on a case-by-case basis on the facts of the case. The court decides maintenance based on following parameters:


* Income of the respondent and petitioner,
* Needs and requirements of the respondent and petitioner,


* Whether they are living in the same household or not,


* Any special needs of the Petitioner,
* Liabilities of the respondent,


* Number of persons who are to be maintained by the respondent.

Maintenance after death of the Children:

The spouse or offspring of the deceased children also can not escape the liability of maintenance. Though it would be decided on separate parameters. The court may order that a portion of a person's wealth and assets be given to parents in case of intestate succession and the same would be applicable as per the rules of succession. Otherwise also, the court can make adequate provision from the estate left after paying debts for the maintenance of children. Sadly The Maintenance and Welfare Of Parents And Senior Citizens Act 2007 or other acts don't cast any liability on the daughter-in-law/son-in-law to provide for maintenance from her/ his earnings.

Process of claiming Maintenance:

Maintenance under The Maintenance and Welfare Of Parents And Senior Citizens Act, 2007 can be applied in a tribunal set by state government. In Delhi, SDM is vested with authority to pass an order for maintenance. The process is simpler and shorter and the normal rule of leading evidence etc is dispensed with.

Maintenance under CrPC 125 has to be applied in the magistrate court having territorial jurisdiction over the children or parents. In most states now these cases are now referred in the Family Court.

Maintenance under Hindu Adoptions and Maintenance act can be applied in the family court or civil court. In metropolitan areas the original suit can also be filed in the High Court if pecuniary jurisdiction is of High Court.

These courts/ tribunals would first try to bring amicable settlement between parties to arrive at a settlement of maintenance amount and the order passed can be enforced as per the specific act by attachment of properties or by putting in civil prison.

करें जतन

बाग, बागीचे, वन..

फुलवामा में न जाने कितने
घरों के फुल मुरझा गए

किसान अपनी लाशें बिछा गए
बेरोजगारी से न जाने कितने
युवा अरमानों को तिलांजली लगा गए
प्रशासनिक लापरवाही से कितने
घरों में मातम के साये छा गए
(अभी)नेताओं को मगर
नही कोई सरोकार।
देख पक्ष विपक्ष में
नही कोई जिम्मेदार
रोक न पाती भारत माता अपने
आसुओं की धार
सुबक सुबक कर जब
करती यही विचार
देश बडा या
बड़ा शब्द ये चौकीदार!!
अभिनेता बने नेता करते
एक दूजे पर पलटवार
वार का शस्त्र और नही कोई
वो तो है बस शब्द ये चौकीदार!!

अभिनंदन, ये शब्द हाल ही में

पाकिस्तान में हुए हमले के बाद

सच्चाई, साहस, शौर्य, विश्वास,

जुझारूपन और निष्ठा का प्रतीक

बन गया है। मगर हमारे देश की

महिलाएं तो सदियों से इन गुणों

का प्रतीक रहीं है..

Our Contribution towards the Nation, Patriots and the Society.

We fight for our ideology but not for our nation. We talk highly about our Patriots..that's it, we do not strive to follow them, forget be remotely like them. 

Well, if that's not possible, there are other ways by which we can contribute a bit towards their sacrifice and towards our Nation.

Rather than being a cry baby or a silent-mock spectator, one of the best way by which we can display our patriotism and contribute toward the betterment of the society (if not possible by any other means) is by "SENSIBLY" expressing our views (both verbally and by self action) on issues affecting the nation and the society in general, thereby justifying our genuine presence as a part of the society.

What is correct/right should be applauded, appreciated and promoted, what's wrong need to be promptly signalled out and if required it should be criticised and condemned as well.

Political-Social affiliations, aspirations, ideology, loyalty, religious/casteist/geographical/territorial based considerations, social status, gender preferences, professional relations should not be an hindrance so as to play a spoil sport. Of course, if one can give better and appropriate solutions-suggestions it should be done right away.

Remember, our gratitude as true children's, towards our motherland lies in we, being an alert, attentive, upright, responsible, stable, unbiased, non compromising, cognizance taking citizens leading from front, thereby setting an example.

WHAT IS PUBLIC INTEREST LITIGATION ?

“Public interest Litigation“, in simple words, means, litigation filed in a court of law, for the protection of “Public Interest”, such as Pollution, Terrorism, Road safety, Constructional hazards etc. Any matter where the interest of public at large is affected can be redressed by filing a Public Interest Litigation in a court of law.

PUBLIC INTEREST LITIGATION is not defined in any statute or in any act. It has been interpreted by judges to consider the intent of public at large. Although, the main and only focus of such litigation is “Public Interest” there are various areas where a PUBLIC INTEREST LITIGATION can be filed.

WHO CAN FILE A PUBLIC INTEREST LITIGATION?

In normal cases, it is seen that the aggrieved party i.e. the victim, who is affected has to file his case in a court of law. That person should have an interest in the dispute. But in filing of Public Interest Litigation there is no such condition. Any person can file a Public Interest Litigation. The only condition being that the same has to be filed in Public Interest. 

Public Interest Litigation is litigation introduced in a court of law, not by the aggrieved party but by the court itself or by any other private party. It is not necessary, for the exercise of the court’s jurisdiction, that the person who is the victim of the violation of his or her right should personally approach the court. Public Interest Litigation is the power given to the public by courts to protect interest of public at large.

Such cases may occur when the victim does not have the necessary resources to commence litigation or his freedom to move court has been suppressed or encroached upon. The court can itself take cognizance of the matter and precede suo motu or cases can commence on the petition of any public-spirited individual.

चुनाव और वसीयत

चुनाव का समय आते ही, जैसे वसीयत बनते या
बताते समय सभी नज़दीकी और दूर दराज के
रिश्तेदार, जिन में से कइयों से आखरी बार कब
मुलाकात हुई हो याद भी नही होता, वैसे ही
(अभी)नेता, अधिकारी, कॉरपोरेटर, प्यादे, चमचे,
चेले चपाटे, अठन्नी, चवन्नी, छुट्टन हाजरी लगाना
शुरू हो जाते है।

वैसे चुनाव के परिपेक्ष में अमूमन जिसकी वसीयत
होती है (जनता) वो चक्रव्यूह में घिरे अभिमन्यु से कम नही
होते और उनका हश्र भी अभिमन्यु सा मिला जुला ही होता है।
फर्क सिर्फ इतना कि वो अभिमन्यु की तरह शहीद
नही किये जाते, बस निढाल करके कोमा में डाल
दिये जाते है, जो आस पास क्या हो रहा है देख तो सकते है मगर कर कुछ भी नही सकते।

अमूमन 5 सालों बाद ये फिर कोमा से बाहर आते
है (लाये जाते है), वादों, घोषणाओं, उम्मीदों रूपी
एंटीबायोटिक्स से स्वस्थ, तंदुरुस्त किये जाते है

ध्यान रहें, वसियतदार जब तक बागबान रूपी
महानायक बच्चन जैसे कठोर नही बनेंगे तब तक
उनकी अहमियत वसीयत बनने तक ही सीमित
रहेगी ये जानना, समझना, समझाना, सचेत करना
और सचेत रहना समय की पुरजोर जरूरत है
वरना ये कोमा और एंटीबायोटिक्स का चक्रव्यूह
सजता और रचता रहेगा और अभिमन्यु होंगे हम.......
